1. Before the Start Date of the Residential Tenancy Agreement

a) General Conditions

• These conditions do not apply to replacement tenants taking over an agreement. Please refer to Section 5 for cancellation rules specific to replacement tenants.
• All cancellation requests must be submitted in writing via email.

b) If cancellation is submitted 14 days or more before the start date:

• The holding deposit is non-refundable.
• The bond will be fully refunded.
• The tenancy agreement will be terminated.

c) If cancellation is submitted 13 days or fewer before the start date:

• The holding deposit is non-refundable.
• An administrative fee of AUD 250 will apply.
• The applicant is responsible for rent payments until a replacement tenant is found and approved.
• Any outstanding charges (e.g. rent, fees) will be deducted from the bond, and the remaining amount (if any) will be refunded.
• The tenancy agreement will be terminated once the replacement tenant pays the deposit, bond, and signs the agreement.

d) Replacement Responsibilities

• Applicants must find their own replacement tenant.
• Rent is payable until an approved replacement is found.
• Vacant rooms are prioritised for new bookings before replacements.
• All replacements must be approved by Dwell and must be new students (not current residents).

e) Dwell East End reserves the right to recover reasonable costs (e.g. cleaning, advertising, admin fees, and lost rent) from the holding deposit or bond until a replacement is found.

2. After the Start Date of the Residential Tenancy Agreement

a) Applies to both original and replacement tenants.

b) Cancellations must be made using a ‘Notice to Leave by Tenant’ form, which is available at reception.

c) If cancellation is submitted after the agreement start date:

• The holding deposit (used as initial rent) will be forfeited if any balance remains.
• A AUD $250 admin fee will be charged (this cannot be deducted from the bond).
• Rent is payable until a replacement tenant is found and approved.
• Outstanding charges will be deducted from the bond. The balance will be refunded (if any).
• The agreement will end once the replacement pays the deposit, bond, and signs the agreement.

d) Replacements must be:

• Found by the current resident.
• Approved by Dwell.
• New students, not current dwell East End tenants.

e) Departing tenants must allow 3 working days for cleaning and maintenance prior to the next tenant’s move-in. Rent for this period is payable.

f) A Bond Claim Form must be completed before departure. Refunds are subject to inspection.

g) Keys must be returned to reception before 10:00 AM on the day of departure. Late returns will incur charges unless pre-arranged.

h) Reasonable costs may be deducted from the holding deposit or bond if early termination applies and no replacement has been secured.

3. Visa Denial (International Students Only)

a) If the visa is refused and notification is given to Dwell East End within 24 hours, you may terminate your agreement under these terms:

i) Full refund of deposit and bond:

• Provide a visa rejection notice within 24 hours.
• Submit the cancellation form 14+ days before the agreement start date.

ii) Partial refund:

• Submit cancellation 13 or fewer days before the start date.
• Holding deposit is forfeited.
• A $250 admin fee is deducted from the bond.

iii) No refund:

• Submit a cancellation after the agreement start date.
• Holding deposit and bond are forfeited.

b) If the visa status is not known by the start date:

• Notify dwell East End.
• Holding deposit will be applied as rent.
• Once depleted, the contract is terminated, and the room is reassigned.
• Bond will be forfeited.

4. Cancellations by Replacement Tenants Before Start Date

• Cancellation requests should be made through email.

i) 14+ days before start date:

• Holding deposit is forfeited.
• The replacement is responsible for the rent until a second replacement is found.
• Outstanding charges are deducted from the bond.

ii) 13 or fewer days before start date:

• Holding deposit is forfeited.
• AUD $250 admin fee applies.
• Rent remains payable until a second approved replacement is found.

Additional Notes:

• Replacements must be students from higher education institutions, not current dwell tenants.
• Departing replacements must submit a Bond Claim Form.
• Reasonable costs may be recovered from the holding deposit or bond.

5. Cancellations by Dwell East End

a) Incomplete applications may be cancelled if not completed within the given timeframe. In such cases, dwell may retain the holding deposit and/or apply admin fees.

b) Dwell may cancel a booking before or during the tenancy if:

• The applicant provided false or misleading information, or
• Failed to comply with booking terms.

c) If cancelled under these conditions, holding deposit and other payments may be retained, to the extent permitted by local law.

The above cancellation policy is a synopsis of the property’s cancellation policy. There could be a few changes incorporated from time to time. Hence, we recommend you review the full Accommodation Contract for a comprehensive understanding of their cancellation policies.

1. Cancelling Before Agreement Start Date (Original Tenants)

• Not applicable to replacement tenants (see Section 5).
• Cancellation requests are made through email.

a. Cancel 14+ days before the start date:

• Holding deposit is forfeited.
• Bond is refunded.
• The agreement is terminated.

b. Cancel 13 or fewer days before the start date:

• Holding deposit is forfeited.
• AUD $250 admin fee applies.
• You must pay rent until a replacement tenant is found.
• Outstanding charges deducted from the bond.
• The agreement ends when the replacement signs and pays.

Note:

• You must find your own replacement
• Dwell fills already vacant rooms first
• Replacement must be an approved student (not an existing tenant)
• Dwell can deduct reasonable costs (cleaning, admin, etc.) from the holding deposit or bond

2. Cancelling After Agreement Start Date (Original & Replacement Tenants)

• Submit a ‘Notice to Leave by Tenant’ form at reception

a. Cancel after start date (checked in or not):

• Holding deposit used for rent; any remaining is forfeited.
• AUD $250 admin fee (paid directly; cannot be deducted from bond)
• You must pay rent until a replacement is found.
• Costs (e.g. rent, cleaning) are deducted from the bond.
• The agreement ends when the replacement signs and pays.

b. Additional responsibilities:

• Find your own replacement.
• Allow 3 business days for cleaning/maintenance before new tenant arrives (you pay rent for this time).
• Submit the Bond Claim Form before leaving
• Return keys by 10:00 AM on move-out day or face extra charges
• Dwell may deduct reasonable costs from the holding deposit or bond

3. Visa Denied (International Students Only)

a. Full refund of holding deposit & bond if:

• Visa refusal is reported to dwell within 24 hours, and
• Cancellation form submitted 14+ days before start date

b. Forfeit holding deposit, partial bond refund if:

• Visa refusal reported.
• The form was submitted 13 or fewer days before the start date.
• An AUD $250 admin fee applies (deducted from the bond).

c. Forfeit holding deposit & bond if:

• Visa refusal is reported after the start date.
• No notice = rent charged until a replacement is found.
• If the visa status is unknown by the start date, the holding deposit covers rent until used up → contract terminated, bond forfeited.

4. Cancelling Before Start Date (Replacement Tenants)

•  Cancellation requests are made through email.

a. Cancel 14+ days before the start date:

• Holding deposit is forfeited
• You must find an approved second replacement
• You continue paying rent until they sign and pay.
• Charges (admin, rent) are deducted from the bond.

b. Cancel 13 or fewer days before the start date:

• Same as above, plus an AUD $250 admin fee

Note:

• You are responsible for finding your own second replacement.
• The bond claim form must be completed before departure.
• Reasonable costs may be deducted from the holding deposit or bond.

5. Cancellation by Dwell

• Dwell may cancel incomplete applications after the deadline and retain fees.
• Dwell may also cancel your booking if:

1. False/misleading info was provided.
2. You fail to meet booking obligations.

• If cancelled, Dwell may retain your holding deposit and/or other payments.

The above cancellation policy is a synopsis of the property’s cancellation policy. There could be a few changes incorporated from time to time. Hence, we recommend you review the full Accommodation Contract for a comprehensive understanding of their cancellation policies.

- When you book, you are required to pay a 1-week deposit to reserve your room which will go towards your first rental payment. You are also required to pay a bond (equivalent to 4 weeks rent) within 1 week of the deposit payment. This will be registered in Victoria with the RTBA (Residential Tenancies Bond Authority), and in South Australia with the CBS (Consumer and Business Services) and held as a security deposit for the duration of your stay. It will be then be refunded at the end of the tenancy, provided you have no outstanding rent, damages to the room or cleaning fees.

- If you book a short-stay you do not need to pay a bond. Though a deposit will be required. If there are any damages to your room when you leave you will be charged accordingly.
