Dwell Student Living UK Cancellation Policy
Once you sign a housing contract with Dwell Student Living UK, it's a legally binding agreement, meaning you're responsible for all accommodation costs outlined in it. You can only be released from this contract under the following specific conditions:
1. Three-Day Cooling-Off Period (for contracts signed by July 31st, 2025):
- If you signed your contract on or before July 31st, 2025, you have a 72-hour (including weekends) cooling-off period to cancel. To do so, you must submit a "Cancellation Request" through the dwell portal under the "Your Requests" tab within this timeframe, and it needs the team's approval.
- If you request the cancellation more than 72 hours after signing, or if you sign on or after August 1st, 2025 (when the cooling-off period doesn't apply), you'll remain responsible for the contract until a suitable replacement tenant is found, as detailed below.
2. Finding a Replacement Tenant:
- You can be released from your contract if you submit a "Cancellation Request" via your dwell portal ("Your Requests") and find a suitable replacement tenant for your room. You'll need to provide their full name and dwell ID in your request, and the following conditions must be met:
- The team must approve the replacement tenant.
- The replacement tenant will pay the current rent price for the room.
- You must pay any administration fees for transferring the tenancy, along with any outstanding rent up to the end of your tenancy.
- You must pay any reasonable charges determined after an inspection of the room and flat at the end of your occupancy.
- The new tenant must pay all required deposits and any outstanding rent for the room.
- The new tenant must sign a tenancy agreement for the remainder of your original fixed term.
- The new tenant must provide all necessary documents, including guarantor information if required.
- If your tenancy has already started and you've moved in, you will be charged a £50 fee to cover the costs of preparing the room for the new tenant.
These are the primary ways to cancel your contract. However, there are other options for cancellations under specific special circumstances if you meet all the requirements:
Special Circumstances:
First Year Guarantee:
- If you're entering your first year of a Foundation or Undergraduate program and don't achieve the required grades, you can be released from your contract.
- You must submit a cancellation request through your dwell portal with official evidence of your results within 48 hours of receiving them.
- This guarantee doesn't apply if you've already completed a Foundation year. If approved, any deposit or rent paid will be fully refunded.
- The required evidence includes a UCAS letter/screenshot or a college/university letter showing your full name, course, and details of not meeting the grade requirements.
International Students:
- If you're an international student requiring a visa for your studies and your visa application is denied before your contract starts, you can cancel your contract.
- You need to submit a cancellation request via your dwell portal with supporting evidence before your contract start date. This applies to international students needing to travel to the UK for their studies.
- If approved, any deposit or rent paid will be fully refunded. Acceptable evidence includes a visa rejection letter showing your full name and the reason for rejection, or a college/university letter confirming your full name, course, and failure to gain a place.
If none of the above cancellation conditions (Cooling-Off Period, Replacement Tenant, or Special Circumstances) are fully met, you will remain responsible for all rent and fees associated with your contract.
If the sales team reviews your situation and confirms that you've met all the conditions for any of the cancellation scenarios, you'll receive a full refund for any deposit or rent paid.
However, if your tenancy has started and you've occupied the room, a £50 preparation fee will be charged, and you'll also be charged rent for the period you occupied the room before cancellation.
Cancellations During the 2024/25 Academic Year:
- If your booking is for the 2024/25 academic year, the cooling-off period (which ended on July 31st, 2024) has passed.
- Therefore, the contract can only be cancelled if a suitable replacement tenant is found and meets all the conditions outlined in the "Replacement Tenant Found" section above. You will be responsible for the rent until the replacement tenant's contract begins.
- All cancellation requests should be submitted via the dwell portal.
- If a suitable replacement tenant is found and meets all criteria, you'll be liable for rent up to their contract start date, and the team will inform you of the amount owed and confirm your release. Failure of a new tenant to sign and meet all criteria means you remain responsible for the full rent until your original contract end date. If your tenancy has started and you've occupied the room, a £50 preparation fee will apply.
